Terms and Conditions for Maths by James Tutoring Sessions

Please read these Terms and Conditions carefully before booking a tutoring session with Maths by James. By booking a session, you agree to be bound by these terms.

1. Payment and Booking

All tutoring sessions must be booked and paid for upfront before the session takes place. Sessions won't be confirmed until payment is received. Whether that be single sessions or blocks of sessions.

2. Punctuality and Preparation

It is the responsibility of parents/guardians to ensure the student is on time for their scheduled tutoring session. Any issues or concerns that may affect the session, such as technical difficulties or a need to reschedule, must be reported with 24 hours' notice prior to the session start time.

3. Cancellation Policy

A minimum of 24 hours' notice is required to cancel or reschedule a tutoring session without charge. If you cancel with less than 24 hours' notice, or if the student does not attend a scheduled session, you will be charged for the full session fee.

4. Technology and Access

Maths by James isn't responsible for any issues arising from your technology not working correctly (e.g., internet connection, microphone, camera, software compatibility) or for you misplacing the link required to access your online tutoring session. We recommend testing your technology and access link well in advance of your session.

5. Cancellation by Maths by James

Maths by James reserves the right to cancel any tutoring session at any point. In the event that Maths by James cancels a session, you will receive a full refund for that session. Furthermore, Maths by James reserves the right to refuse or discontinue services to any person at any time for any reason, without needing to provide a specific cause. If you have any questions regarding these terms, please don't hesitate to contact Maths by James.

6. Student and Parent/Guardian Conduct

Students and parents/guardians are expected to engage respectfully and appropriately during all tutoring sessions and in all communications with Maths by James. Disruptive, disrespectful, or inappropriate behaviour, including but not limited to verbal abuse, harassment, or any form of intimidation, will not be tolerated. Maths by James reserves the right to terminate a session immediately without refund if the conduct of the student or parent/guardian is deemed unacceptable. Repeated instances of poor conduct may result in the refusal of future tutoring services.

7. Lateness Policy

To ensure all students receive their full session time and to maintain the tutor's schedule, the following policy applies to all 1-to-1 and group tutoring sessions.

Punctuality and Session Duration

Sessions will begin promptly at the agreed-upon time.

The session will end at the scheduled time or a few minutes before, regardless of when the student joins.

No additional time will be added to a session if a student is late for the agreed-upon start time.

Financial Implications

Students who are late will still be charged for the full duration of the session, as the tutor's time is booked for the entire period.

Tutor Lateness

In the unlikely event that a tutor is late, they will make every reasonable effort to add the missed time to the end of the session or offer a pro-rata refund for the lost time, as per our Refund Policy.

By booking a session with Maths by James, you agree to this Lateness Policy.

8. Specific Topic Requests

Advance Notice for Requests: If a student wishes to work on a specific topic or a particular question during a 1-to-1 or group tutoring session, they must provide the tutor with at least 24 hours' notice before the scheduled session.

Reason for Policy: This advance notice allows the tutor to prepare the necessary materials, resources, and examples to provide the most effective and high-quality instruction.

Tutor's Discretion: If a student makes a specific request with less than 24 hours' notice, the tutor will do their best to accommodate it. However, the tutor reserves the right to decline the request if they feel they cannot provide an adequate lesson without proper preparation. In this case, the session will proceed with the general learning plan as agreed upon with the student or parent/guardian.

Scope of Requests: This policy applies to all forms of tutoring—1-to-1 and group sessions. For group sessions, the tutor will aim to incorporate the requested topic if it is relevant to the curriculum and beneficial to the entire group.

By booking a session with Maths by James, you acknowledge and agree to this policy regarding specific topic requests.

9. No Guarantee of Results

While we are committed to providing high-quality tutoring and educational resources to support students' learning and progress, we cannot guarantee specific academic outcomes or results. Our services are designed to supplement and enhance a student's existing learning, but a student's ultimate success depends on various factors beyond our control, including but not limited to their individual effort, dedication, study habits, and the curriculum and teaching methods of their school or institution.

By using our services, you understand and agree that Maths by James does not promise or guarantee that a student will achieve a particular grade, score, or pass a specific exam. You acknowledge that any testimonials or past results shared on our platform are not a guarantee of future performance.

10. Session Recording and Use of Content

Recording of Sessions: By agreeing to these terms, you grant Maths by James the right to record all online sessions, including 1-to-1 and group tutoring. These recordings are made for quality assurance, training, and safeguarding purposes.

Use of Session Content for Marketing: You also grant Maths by James a non-exclusive, perpetual, royalty-free license to use portions of these recordings and the student's work for marketing, promotional, and training purposes. This may include, but is not limited to, sharing clips on our website, social media channels, or in promotional materials.

Anonymity: We will make every reasonable effort to anonymize the student's identity in any public-facing content used for marketing, unless we have obtained separate, explicit consent from the parent or guardian to use identifiable information (such as the student's first name or image).

Your Consent: You acknowledge that your agreement to these terms serves as your consent to the recording of sessions and the use of the content as described above. If you do not agree to these terms, you should not book or attend a session with Maths by James.
